A train-on-train crash that left one train engineer dead in October has led to a wrongful death lawsuit against Union Pacific.

According to Fox Denver, the wife of late train engineer Jason Martinez is seeking unknown damages against Union Pacific in a lawsuit that claims the company was negligent for failing to properly inspect or maintain the train’s brake system.

Martinez’s train collided with a parked train in Wyoming after its brake system malfunctioned. The National Transportation Safety Board investigators announced the final recorded speed of Martinez’s train before it crashed was 56 mph. The train-on-train crash also left conductor Benjamin Brozovich dead.

According to The Tribune, Union Pacific spokeswoman Kristen South says the company is aware of the lawsuit and is in contact with Martinez’s spouse.
