Hurricane Irma made landfall over the southern Florida mainland on Sunday, Sept. 10 last year as a Category 3 storm, packing winds of more than 110 miles per hour.

The City of Cape Coral received a notification that a tree was blocking a stop sign at a local intersection one day before the deadly crash, according to court documents.

The woman’s family said in the lawsuit that the Hurricane Irma debris should have been removed and it would have prevented the tragedy.

“As far as the justice that needs to be done…the City needs to take responsibility. They should have been on top of that,” the driver of the other car involved in the crash told reporters.
